Reverse domain name hijacking overview
This epsiode of Vondran Legal Hour discusses the growing phenomena of the "trademark bully." This show is general legal information only and not legal advice. A trademark bully is a company that owns a federally registered trademark that believes it can force other pcmpanies (by use of threats, intimidation, fear, and express or implied threats of litigation) to force you to turn over control of your property (i.e. your domain name) to them, usually free of charge. This type of acticity raises issues over Civil Extortion, RICO, and may raise an issue over legal damages under the Anti-Cybersquatting Consumer Protection Act ("ACPA"). This is serious business and you should not take this lighlty if you recieve a cease and desist letter from these companies demadning that you succumb to them because they have a trademark. These types of over-reaching activities should be challenged and exposed.
