Nationally recognized immigration and criminal defense attorney, Sara Elizabeth Dill, of the national law firm of Perry, Krumsiek & Jack, LLP will be appearing on ALR/PRA Radio again tomorrow to discuss Arizona's SB1070, the controversial immigration legislation recently signed into law by Governor Jan Brewer. This legislation seeks to usurp federal authority over immigration law, use racial and ethnic profiling to make arrests, and basically gives law enforcement officers and state criminal courts the power to enforce immigration law and make determinations of whether a person is lawfully in the country. Finally, it seeks to criminalize, for the first time, being present in the United States without documentation or authorization. Sara will be discussing the specifics of the bill (you can do a simple Google search for SB 1070), why it is unconstitutional, what effect it is going to have, and the problems in actually implementing the specific provisions of the legislation. Topics to be covered include: 1. The law (SB1070), what it actually says and how it will be implemented; 2. Constitutionality of the law and federal vs. state authority; 3. Arguments for and against the law; and 4. The national response.
