Gail S. Smyth, a sole law practitioner, admitted in California, specializes in real property, loan servicing, and title issues.  Employed by the Federal Deposit Insurance Corporation during the banking crisis in the early 90s and also again during the 2009 crisis, she supervised an in-house litigation department and later was assigned to several bank receiverships in California, Nevada and Idaho, managing the assets and litigation of the failed banks. She spent eight years working in the mortgage default servicing industry where she headed a sub-prime servicing unit handling title issues pre-funding through post REO sale, established an internal title claim tracking system, managed outside litigation, and developed settlement strategies and workouts. While at Fidelity Title Insurance Company she investigated, analyzed and resolved complex title and escrow issues, drafted underwriting decisions, managed outside counsel and negotiated settlements. Earlier in her career she represented a developer of multi-family low-income housing projects in the Western US where she drafted multi-state construction loan documents, legal opinions and reviewed engineer’s opinion, survey documents and attended pre-construction conferences and loan closings.  Currently she serves as a Trustee for the Amador County Law Library. She is qualified as a mediator for the Third Appellate District in Sacramento, California and has mediated several cases involving loans and/or foreclosures. Her published articles include Keep Your Home California, part of the President Obama’s Hardest Hit Fund, The Independent Foreclosure Review OCC, and Transfer On Death Deed.
